Legal Basis:
According to article 49 of the Consumer Defense Code, the right of withdrawal applies only to physical products or services contracted at a distance that have not been used or delivered immediately.
As HEROI MENU products are digital, manually delivered and of a personalized nature (resale of individual and non-transferable license), the right of withdrawal does not apply, according to consolidated understanding by Procon-SP and STJ jurisprudence.
According to BCB Resolution No. 103/2021 and BCB Circular No. 3.978/2020, the use of the Special Refund Mechanism (MED Pix) should only occur in cases of proven fraud.
Thus, any attempt to open a contestation, chargeback or misuse of MED Pix after product delivery will be considered bad faith, fraud and attempt at illicit enrichment, according to articles 171 (Embezzlement), 168 (Undue Appropriation) and 340 (False Communication of Crime) of the Brazilian Penal Code.

Parágrafo 4.1.1 - Definition and Scope:
The so-called "permanent licenses" or "lifetime" marketed by HEROI MENU are valid exclusively during the period in which the product remains active and available for marketing in our digital catalog. The term "permanent" refers to the non-temporal nature of the license while the product is in stock and active on the platform, not constituting a guarantee of absolute perpetuity.
Parágrafo 4.1.2 - Commercial Availability Condition:
The validity of the permanent license is intrinsically linked to the commercial availability of the product. If the software is removed from the catalog, discontinued by the original developer, withdrawn by administrative decision of HEROI MENU, or ceases to be marketed for any technical, legal or commercial reason, the license automatically and irreversibly loses its validity.
Parágrafo 4.1.3 - Extinction of Post-Withdrawal Responsibility:
Once the product is removed from the catalog or ceases to be available for marketing, HEROI MENU has no contractual, technical or legal obligation to maintain: (a) access to the platform or user login; (b) software updates, patches or fixes; (c) technical support or service; (d) integration with servers or related services; (e) any form of maintenance or continuity of service.
Parágrafo 4.1.4 - Disclaimer After Catalog Exit:
HEROI MENU expressly declares that it is not responsible, under any legal basis (contractual, extra-contractual, consumer or civil), for losses, damages, direct or indirect damages resulting from the removal of the product from the catalog, discontinuation by the original developer, or impossibility of maintenance of the service after the product's exit from the store. The customer, when purchasing a permanent license, expressly acknowledges and accepts that validity is conditioned on the permanence of the product in the catalog.
Parágrafo 4.1.5 - Conditional Nature of the License:
The customer agrees that the acquisition of a permanent license constitutes tacit and express acceptance that its validity is conditional and dependent on the maintenance of the product in HEROI MENU's commercial catalog. This condition is an integral part of the purchase and sale contract, not being considered an abusive clause, but an essential element of the service provision.
Parágrafo 4.1.6 - Legal and Jurisprudential Basis:
Legal Basis: Articles 421, 422 and 425 of the Brazilian Civil Code — contracts must observe their social function, objective good faith and contractual balance, respecting the conditions agreed between the parties. According to consolidated STJ jurisprudence (REsp 1,559,168/SP, REsp 1,417,921/RS), software licensing contracts may establish validity conditions linked to commercial availability, not constituting an obligation of perpetuity or maintenance after removal of the product from the market. The permanent license is granted during the period of commercial availability of the product, not constituting an obligation of perpetuity, continuity or maintenance after its withdrawal from the commercial catalog.
