Terms of Service & Policies - HEROI MENU

1. ABOUT HEROI MENU

HEROI MENU acts as a payment intermediary and access facilitator for digital products, including scripts, tools, and third-party game software.

Attention: None of the products sold are developed by HEROI MENU.
The store only intermediates payment and access between the customer and the original developer, performing value conversion and payment methods such as cryptocurrencies.

Products are presented for exposure and purchase facilitation, being delivered only after release by the original developer and payment confirmation.

2. PURCHASE POLICY

By making any purchase at HEROI MENU, the customer declares to be aware of and agree with the following terms:

2.1 Delivery and receipt confirmation

  • Product delivery is manual, and occurs through the same channel used in the purchase (such as Discord, WhatsApp, Telegram or other informed by the customer).
  • After payment confirmation and proof submission, the product (activation key, file or access) is delivered personally by an authorized HEROI MENU attendant.
  • Every delivery is digitally recorded (with logs, screenshots, receipts and messages) and serves as proof of effective delivery.
  • The process is considered completed at the moment the key or access is sent to the buyer.

2.2 Purchase irreversibility and absence of right of withdrawal

As it is a digital, resale and personalized product, we do not accept returns, refunds or cancellations after shipment, except in the following exceptions:

  • The activation key was not delivered;
  • The product was under maintenance or suspended at the time of purchase, duly proven by the administration.

Legal Basis:
According to article 49 of the Consumer Defense Code, the right of withdrawal applies only to physical products or services contracted at a distance that have not been used or delivered immediately.
As HEROI MENU products are digital, manually delivered and of a personalized nature (resale of individual and non-transferable license), the right of withdrawal does not apply, according to consolidated understanding by Procon-SP and STJ jurisprudence.

2.3 Contestation or misuse of MED Pix

According to BCB Resolution No. 103/2021 and BCB Circular No. 3.978/2020, the use of the Special Refund Mechanism (MED Pix) should only occur in cases of proven fraud.

Thus, any attempt to open a contestation, chargeback or misuse of MED Pix after product delivery will be considered bad faith, fraud and attempt at illicit enrichment, according to articles 171 (Embezzlement), 168 (Undue Appropriation) and 340 (False Communication of Crime) of the Brazilian Penal Code.

HEROI MENU reserves the right to:

  • Register a Police Report (B.O.);
  • Gather digital evidence (messages, IPs, logs and receipts);
  • And file civil and criminal legal action against the responsible buyer.

2.4 Immediate measures in case of contestation

When opening a dispute, contestation or refund request (including via Pix or banking institution), the buyer:

  • Immediately loses the right to use the software;
  • Has their license blocked and access revoked, without prior notice;
  • Is permanently banned from HEROI MENU, being prohibited from making new purchases or interacting with any official channel.

2.5 Buyer responsibility

  • The customer is entirely responsible for the use of purchased products and for all actions taken after receipt.
  • Upon completing payment, the buyer acknowledges that delivery is manual, recorded and digital, and that no refund will be due after release, except for the legal exceptions provided.

2.6 Fraud attempts and abuse

  • HEROI MENU cooperates with authorities, financial institutions and payment platforms in investigations of scams, misuse of MED Pix or false fraud allegations.
  • Attempts at undue chargeback, malicious contestation or digital fraud may generate civil and criminal liability, including indemnifications, definitive blocking and formal communication to competent authorities.
3. DELIVERY & SUPPORT
  • Delivery is made manually after payment confirmation, in the same channel where the buyer sent the proof.
  • Support is available only for basic technical guidance and frequent questions, not offering customizations or modifications to the original software.
  • Products may undergo updates, fixes or deactivations without prior notice, as determined by developers.
4. DISCLAIMER
  • HEROI MENU does not guarantee that products will meet the specific needs of each customer.
  • We do not ensure permanent operation after game updates, operating systems or new content.
  • We are not responsible for bans, account losses or direct/indirect damages arising from product use.
  • Each computer and configuration are unique — individual failures may occur.
  • HEROI MENU has no obligation of continuous maintenance or lifetime support for products removed from the catalog.

4.1 Permanent Licenses (or Lifetime)

Parágrafo 4.1.1 - Definition and Scope:
The so-called "permanent licenses" or "lifetime" marketed by HEROI MENU are valid exclusively during the period in which the product remains active and available for marketing in our digital catalog. The term "permanent" refers to the non-temporal nature of the license while the product is in stock and active on the platform, not constituting a guarantee of absolute perpetuity.

Parágrafo 4.1.2 - Commercial Availability Condition:
The validity of the permanent license is intrinsically linked to the commercial availability of the product. If the software is removed from the catalog, discontinued by the original developer, withdrawn by administrative decision of HEROI MENU, or ceases to be marketed for any technical, legal or commercial reason, the license automatically and irreversibly loses its validity.

Parágrafo 4.1.3 - Extinction of Post-Withdrawal Responsibility:
Once the product is removed from the catalog or ceases to be available for marketing, HEROI MENU has no contractual, technical or legal obligation to maintain: (a) access to the platform or user login; (b) software updates, patches or fixes; (c) technical support or service; (d) integration with servers or related services; (e) any form of maintenance or continuity of service.

Parágrafo 4.1.4 - Disclaimer After Catalog Exit:
HEROI MENU expressly declares that it is not responsible, under any legal basis (contractual, extra-contractual, consumer or civil), for losses, damages, direct or indirect damages resulting from the removal of the product from the catalog, discontinuation by the original developer, or impossibility of maintenance of the service after the product's exit from the store. The customer, when purchasing a permanent license, expressly acknowledges and accepts that validity is conditioned on the permanence of the product in the catalog.

Parágrafo 4.1.5 - Conditional Nature of the License:
The customer agrees that the acquisition of a permanent license constitutes tacit and express acceptance that its validity is conditional and dependent on the maintenance of the product in HEROI MENU's commercial catalog. This condition is an integral part of the purchase and sale contract, not being considered an abusive clause, but an essential element of the service provision.

Parágrafo 4.1.6 - Legal and Jurisprudential Basis:
Legal Basis: Articles 421, 422 and 425 of the Brazilian Civil Code — contracts must observe their social function, objective good faith and contractual balance, respecting the conditions agreed between the parties. According to consolidated STJ jurisprudence (REsp 1,559,168/SP, REsp 1,417,921/RS), software licensing contracts may establish validity conditions linked to commercial availability, not constituting an obligation of perpetuity or maintenance after removal of the product from the market. The permanent license is granted during the period of commercial availability of the product, not constituting an obligation of perpetuity, continuity or maintenance after its withdrawal from the commercial catalog.

5. PRIVACY POLICY
  • Collected data (name, contact and proof of payment) are used exclusively for purchase and delivery verification purposes.
  • We do not sell, share or pass on data to third parties, unless required by law, in accordance with Law No. 13,709/2018 (LGPD).
6. INTELLECTUAL PROPERTY
  • All site content (name, brand, descriptions, layout, images, banners and texts) belongs to HEROI MENU or the original developers.
  • The use of third-party names and images is merely illustrative, without indicating direct affiliation or sponsorship.
7. FINAL CONDITIONS
  • By making a purchase, the customer declares to have read, understood and accepted all terms described.
  • HEROI MENU may change this document at any time, and it is the customer's responsibility to periodically check for updates.
  • Any attempt at fraud, improper dispute or intentional damage will result in banning and appropriate legal measures.
8. JURISDICTION
  • This site operates under Brazilian laws.
  • The forum of the store owner's place of residence is elected for any judicial dispute or legal claim related to HEROI MENU.
